Amendment to Act on Employment regarding the employment of persons from third countries

Amendment of the Act on Employment (5/2004 Coll.) – aim is to simplify the employment of persons from third countries (non-EU countries). The process of employment has remained the same (temporary residency permit, submission of application at the embassy in his country, the labor contract or promise from Slovak employer, etc.).

Advantage – Slovak employer does not have to notify the labor office on vacant positions if such positions are identified as lack of workforce in districts with average unemployment less than 5%.

Limitations – Slovak employer located in a district with lack of workforce and unemployment less than 5% can employ employees from third countries max. 30% of the total number of its employees.

New condition for issuance of the confirmation for employment of employee from third countries – Slovak employer has not violated the ban of illegal work within last two years prior to submission of application for such confirmation.

The Amendment introduces new obligation of employers – when advertising a work/job offer the employer shall include the information on the sum of basic wages‘ component.

The Amendment becomes effective on May 1, 2018.
